Legislative Provisions
Nuclear Weapons and Testing — Sets the time needed to prepare to conduct a nuclear test at 18 months.
— Repeals the “Spratt-Furse” provision banning low-yield nuclear weapons (less than 5 kilotons). Engineering development will require the approval of Congress.
— Robust Nuclear Earth Penetrator — Engineering development of “bunker busters” will also require Congressional approval.
Tanker Aircraft — Authorizes the Air Force to lease no more than 20 tanker aircraft and purchase up to 80 additional aircraft as part of a multiyear procurement program lasting no more than 10 years.
“Buy America” Provisions — Requires the Pentagon to look at U.S. procurement from foreign sources and identify critical components and capabilities necessary to produce those goods. Would give an advantage in bidding for defense contracts to American companies that use American-made machine tools.
Environmental Regulations — Bars the Interior Secretary from designating areas on military training ranges as “critical habitat” under the Endangered Species Act if they already covered by a Defense Department natural resources management plan. Eases restrictions of the Marine Mammal Protection Act, giving the military greater flexibility to conduct activities that might impact whales and other sea mammals.
Concurrent Receipts — Military retirees rated as at least 50 percent disabled by the Department of Veterans Affairs would be permitted to receive both full retirement and disability benefits. Under current law an individual’s retirement benefits are reduced by the amount of disability benefits they receive.
Base Closures - The Secretary of Defense will determine the threats to U.S. national security and determine “the potential, prudent, surge requirements to meet those threats.” This “surge requirement determination” will guide the 2005 base closure process.
